1. Agreement

This website is operated by PRIME BEE LLC, a Florida limited liability company doing business as Scratch Idea (“Scratch Idea”, “we”, “us”, “our”). By visiting this site or placing an order, you agree to these Terms of Service (the “Terms”), our Shipping policy, our Returns & refunds policy and our Privacy policy, which are part of these Terms. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Our products are intended for adults and are sold for delivery in the United States only.

3. Our products

Scratch Idea sells scratch-off date night card games. Each edition contains 36 scratch-off date cards, 3 guide cards and 1 scratcher. Colors, sizes and packaging may differ slightly from images on the site.

The date ideas on our cards are suggestions for entertainment only. You decide whether an activity is suitable, safe, affordable and legal for you. Always use your own judgment, follow local laws and venue rules, drink responsibly if you choose to drink, and skip any activity that does not suit your health, budget or circumstances. Our cards are not professional, medical, financial or relationship advice.

4. Orders

An order confirmation email means we received your order; it is not yet an acceptance. A contract is formed when we ship your order. We may refuse or cancel any order, limit quantities per customer, or decline orders that appear to be placed by resellers or through fraud. If we cancel an order you have paid for, we refund it in full.

5. Prices and errors

All prices are in US dollars. Prices, products and availability may change without notice. If an item is listed at an incorrect price or with incorrect information because of an error, we may cancel orders for that item and refund you, even after an order confirmation has been sent.

6. Payment and sales tax

Payments are processed securely by our payment providers. You confirm that you are authorized to use the payment method you provide. Sales tax is added at checkout where required by law.

7. Discounts and promotions

Automatic mix & match discounts apply as shown on the product and cart pages. Discount codes are limited to one per order and, where stated, one use per customer; have no cash value; are not transferable; and cannot be combined with other offers unless the offer says so. We may change or end a promotion at any time, and we may cancel orders or discounts obtained through abuse, such as creating multiple accounts. Changes do not affect orders already shipped.

8. Shipping, title and risk of loss

Shipping is described in our Shipping policy. Title to products passes to you when we hand your order to the carrier. We help with lost or damaged parcels as described in that policy.

9. Returns

Because our cards are single-use scratch-offs, only unopened, sealed boxes can be returned, as set out in our Returns & refunds policy.

10. Gift notes

If you add a gift note, you are responsible for its content. We may leave out notes that contain offensive, unlawful or personal financial information. We are not responsible for typing or spelling in notes as submitted.

11. Reviews and content you send us

If you submit a review, photo, video, message or other content, you confirm it is honest, that you own it or have permission to share it, and that it is not unlawful or misleading. You give us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with our business. We may remove any content at our discretion.

Some customer quotes on this site were collected on Amazon.com. Reviews marked as Vine reviews were written by reviewers who received the product free of charge through the Amazon Vine program. We do not edit the wording of reviews we quote.

12. Intellectual property

All content on this site and on our products — including the Scratch Idea name and logo, card artwork, date ideas, photography, videos and text — belongs to PRIME BEE LLC or its licensors and is protected by law. You may not copy, reproduce, sell or create derivative works from it without our written permission.

13. Prohibited use

You agree not to use the site for any unlawful purpose; to interfere with its security or operation; to scrape, copy or harvest its content or data; to submit false information or fraudulent orders; or to infringe anyone’s rights.

14. Third-party services

Our store runs on Shopify, and payments, shipping and other functions are provided by third parties. Their services are subject to their own terms, and we are not responsible for third-party websites linked from our site.

15. Disclaimer

Except as expressly stated in these Terms and to the extent permitted by law, the site and our products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

16. Limitation of liability

To the fullest extent permitted by law, PRIME BEE LLC and its members, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, loss or damage arising from activities you choose to do based on our cards. Our total liability for any claim relating to the site or a product is limited to the amount you paid for the order in question. Some states do not allow certain limitations, so some of these may not apply to you.

17. Indemnity

You agree to indemnify and hold harmless PRIME BEE LLC from claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the site or our products.

18. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally within 30 days. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, except that either party may bring an individual claim in small claims court.

19. Changes to these Terms

We may update these Terms from time to time. The version posted when you place an order applies to that order.

20. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about the site and your orders.
